Welcome to Center for Elder Care Training & Education, also known as CECTE. These Terms of Service govern your access to and use of the CECTE website, online courses, training materials, certificates, consulting services, and related services offered through CECTE.org or any related CECTE platform.
By accessing this website, creating an account, purchasing a course, enrolling in training, using course materials, or engaging CECTE for consulting services, you agree to these Terms of Service. If you do not agree, you should not use this website, purchase a course, or access CECTE materials.

About CECTE
Center for Elder Care Training & Education (CECTE) provides online Assisted Living administrator, manager, staff, dementia, memory care, and related training programs. CECTE also offers professional consulting services for organizations seeking support with Assisted Living operations, regulatory readiness, training, documentation, leadership, quality improvement, or related needs.
CECTE training programs are designed to be practical, operations-focused, and aligned with applicable state regulatory expectations where stated. CECTE does not provide legal, medical, clinical, financial, or regulatory representation services.

No State Approval, Endorsement, or Legal Guarantee
Unless expressly stated in writing, CECTE is not approved, endorsed, certified, sponsored, or authorized by any state agency, licensing authority, or regulatory body.
Some states, including Colorado, do not approve or endorse individual private training providers for certain Assisted Living training requirements. In those cases, the licensee, employer, facility, community, or purchaser remains responsible for determining whether any training program satisfies applicable laws, regulations, licensing requirements, internal policies, or survey expectations.
CECTE makes reasonable efforts to design training programs that align with relevant regulatory expectations and operational best practices. However, CECTE does not guarantee that completion of any course will result in licensure, employment, regulatory approval, survey compliance, avoidance of citations or deficiencies, or acceptance by any agency, employer, licensing authority, or third party.

User Responsibility
You are responsible for reviewing the training requirements applicable to your state, license type, role, employer, facility, and resident population.
Before purchasing or relying on any CECTE course, you should confirm that the course is appropriate for your intended use. This may include confirming requirements with your employer, facility leadership, licensing authority, legal counsel, or other appropriate advisor.
CECTE is not responsible for a user’s failure to verify applicable training requirements before enrollment.

Course Enrollment and Account Access
To access certain CECTE courses, you may be required to create an account and provide accurate information, including your name, email address, payment information, and other details required for enrollment and certificate issuance.
You are responsible for maintaining the confidentiality of your login credentials. You may not share, sell, transfer, lend, or otherwise provide your account access to another person.
Each enrollment is intended for one individual learner only unless CECTE expressly agrees in writing to a group enrollment or organizational access arrangement.
CECTE reserves the right to suspend or terminate account access if it believes an account is being misused, shared improperly, accessed fraudulently, or used in violation of these Terms.

Course Access Period
Course access may be limited to a defined completion window, which may vary by course. The applicable access period will be displayed during enrollment or communicated in course materials.
If a participant does not complete the course within the applicable completion window, access may expire. Extensions may be granted at CECTE’s discretion and may be subject to an additional fee.
CECTE is not responsible for a participant’s failure to complete a course within the assigned access period.

Certificates of Completion
Participants who successfully complete all required course elements, including modules, knowledge checks, exams, attestations, or other requirements, may receive a dated certificate of completion.
A certificate of completion documents completion of the applicable CECTE training course. It does not guarantee state approval, licensure, employment, regulatory acceptance, survey compliance, or professional qualification unless expressly required by applicable law and confirmed by the appropriate authority.
CECTE may withhold or revoke a certificate if it determines that a participant did not complete the course requirements honestly, shared login credentials, misrepresented identity or completion, manipulated course progress, or otherwise violated these Terms.
Exams, Knowledge Checks, and Completion Requirements
Some CECTE courses may include knowledge checks, quizzes, exams, attestations, or final assessments. Successful completion may require achieving a minimum passing score or completing required course steps.
CECTE reserves the right to modify exam structure, passing standards, retake policies, or completion requirements at any time, provided that such changes are applied reasonably and in good faith.
Participants are expected to complete all coursework independently and honestly.

Payments
All prices are listed in U.S. dollars unless otherwise stated. Payment is due at the time of enrollment or purchase unless CECTE agrees in writing to different payment terms.
CECTE may use third-party payment processors to collect and process payments. By submitting payment information, you authorize CECTE and its payment processors to charge the payment method provided.
CECTE is not responsible for errors, delays, or security practices of third-party payment processors, except as required by applicable law.

Pricing Changes
CECTE may change course pricing, launch pricing, promotional pricing, discounts, or standard tuition at any time.
Price changes do not entitle prior purchasers to refunds, credits, or retroactive discounts. Promotional pricing may be limited by date, availability, program, or other conditions established by CECTE.

Refund Policy
Because CECTE courses provide immediate access to digital training materials, all course purchases are generally final once course access has been granted.
CECTE may, at its discretion, consider refund requests submitted in writing via the contact form. Refund decisions may consider whether the participant accessed course materials, completed modules, downloaded materials, attempted assessments, received a certificate, or otherwise used the training.
No refund will be provided after a certificate of completion has been issued.
Group enrollment, consulting services, custom training, and special projects may be subject to separate written refund, cancellation, or payment terms.

Chargebacks and Payment Disputes
If you dispute a charge through your bank or payment provider without first contacting CECTE to resolve the issue, CECTE may suspend course access, withhold certificates, revoke access to materials, or terminate your account while the dispute is pending.

Professional Consulting Services
CECTE may provide professional consulting services by request. Consulting services may include support related to Assisted Living operations, regulatory readiness, training systems, documentation review, leadership support, quality improvement, survey preparation, or other operational needs.
Consulting services are not included in course tuition unless expressly stated in writing.
Consulting engagements may require a separate proposal, scope of work, service agreement, fee schedule, or written approval. CECTE does not guarantee any specific regulatory, licensing, survey, financial, operational, or business outcome from consulting services.

No Legal, Medical, Clinical, or Regulatory Advice
CECTE materials and services are provided for educational, informational, operational, and training purposes only.
CECTE does not provide legal advice, medical advice, clinical direction, financial advice, or regulatory representation. Nothing on the website, in a course, in a certificate, in consulting discussions, or in CECTE materials should be interpreted as legal advice or as a substitute for guidance from an attorney, licensed healthcare professional, regulator, accountant, or other qualified professional.
Users and organizations remain responsible for their own operational decisions, resident care decisions, regulatory compliance decisions, policies, procedures, documentation, staffing, and facility practices.

Training Content and Regulatory Changes
CECTE makes reasonable efforts to maintain accurate and relevant training content. However, laws, regulations, agency guidance, licensing standards, and survey expectations may change.
CECTE does not guarantee that all training materials will reflect every regulatory update immediately after it occurs. Users and licensees remain responsible for confirming current requirements with applicable authorities.
CECTE may update, revise, replace, remove, or modify course content at any time.

Intellectual Property
All CECTE course materials, videos, written content, handouts, quizzes, exams, certificates, graphics, website content, branding, logos, designs, downloadable materials, and related resources are owned by or licensed to CECTE and are protected by copyright, trademark, and other intellectual property laws.
You may access and use CECTE materials only for your own personal training or internal organizational training purposes, as authorized by CECTE.
You may not copy, reproduce, distribute, publish, sell, modify, upload, share, record, screenshot, transmit, create derivative works from, or publicly display CECTE materials without prior written permission.

Prohibited Uses
You agree not to: Share your login credentials with another person
Allow another person to complete coursework under your account
Copy, download, distribute, sell, or reproduce CECTE materials without permission
Use CECTE content to create a competing course, training program, or consulting product
Attempt to bypass course controls, paywalls, progress tracking, exams, or access restrictions
Upload malicious code, interfere with website functionality, or compromise security
Misrepresent your identity, role, course completion, or certificate status
Use CECTE materials for unlawful, misleading, or unauthorized purposes
Post false, defamatory, abusive, or inappropriate content on CECTE platforms
CECTE may suspend or terminate access for any prohibited use.

Testimonials and Reviews
CECTE may display reviews, testimonials, comments, or feedback from users who voluntarily provide them.
By submitting a review or testimonial, you grant CECTE permission to use, reproduce, publish, edit for length or clarity, and display the review in marketing materials, on the website, in social media, or in other promotional content.
CECTE will not knowingly publish fake reviews or testimonials. Reviews should reflect honest opinions and actual experiences.
If a reviewer has a material connection to CECTE, such as employment, compensation, family relationship, discounted services, free services, or another relationship that may affect how a consumer evaluates the review, that connection should be disclosed.

Third-Party Platforms and Services
CECTE may use third-party platforms and services for website hosting, course delivery, payment processing, email communication, analytics, video hosting, security, forms, or other business functions.
CECTE is not responsible for outages, interruptions, data loss, errors, or failures caused by third-party platforms, except as required by applicable law.
Use of third-party services may also be governed by those providers’ own terms and privacy policies.
Website Availability
CECTE makes reasonable efforts to keep the website and course platform available. However, CECTE does not guarantee uninterrupted access.
Website or course access may be unavailable due to maintenance, updates, technical issues, hosting problems, internet outages, security concerns, or events beyond CECTE’s control.
CECTE is not liable for temporary interruptions in website or course availability.

User-Submitted Information
If you submit information through the website, contact forms, enrollment forms, email, or consulting inquiries, you agree that the information you provide is accurate and that you have the right to provide it.
You should not submit confidential resident information, protected health information, medical records, personnel records, or sensitive facility documents unless CECTE has expressly agreed in writing to receive such information under an appropriate confidentiality arrangement.

Privacy, Data Rights, and Account Deletion
CECTE respects user privacy and does not sell personal information.
When users create an account, purchase a course, submit a form, request consulting services, or otherwise interact with CECTE, CECTE may collect information necessary to provide services, process payments, maintain training records, issue certificates, communicate with users, and operate the website and course platform.
Users have the right to request information about the personal data CECTE maintains about them, to request correction of inaccurate information, and to request deletion of their account or personal information, subject to any legal, regulatory, tax, accounting, fraud-prevention, dispute-resolution, course-completion, certificate-verification, or business-record retention obligations that may apply.
CECTE will not sell user personal data to third parties. CECTE may use trusted third-party service providers for necessary business functions, including website hosting, course delivery, payment processing, email communication, analytics, security, forms, and technical support. These providers are used to support CECTE operations and are not authorized by CECTE to sell user data.
Users may request account deletion or data-related assistance by contacting CECTE via the contact form. Upon receiving a request, CECTE will make reasonable efforts to verify the requester’s identity and respond within a reasonable timeframe consistent with applicable law.
If an account is deleted, the user may lose access to purchased courses, training history, certificates, completion records, and related materials. CECTE may retain limited records where necessary for legitimate business, legal, regulatory, accounting, compliance, certificate verification, or dispute-resolution purposes.

Confidentiality
For general course users, CECTE does not intend to receive confidential business, legal, clinical, resident, or protected health information through ordinary website forms or course communications.
For consulting clients, confidentiality obligations may be addressed in a separate written consulting agreement or service agreement.
CECTE may use reasonable measures to protect confidential information it expressly agrees to receive, but users should not submit sensitive information unless appropriate arrangements are in place.

Disclaimer of Warranties
CECTE services, website content, course materials, and consulting resources are provided “as is” and “as available.”
To the fullest extent permitted by law, CECTE disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and suitability for any regulatory, licensing, employment, or compliance purpose.

Limitation of Liability
To the fullest extent permitted by law, CECTE and its owners, officers, employees, contractors, instructors, consultants, affiliates, and representatives shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising out of or related to use of the website, courses, certificates, consulting services, or materials.
CECTE’s total liability for any claim related to a purchased course shall not exceed the amount paid by the user for that specific course.
For consulting services, CECTE’s total liability shall not exceed the amount paid for the specific consulting service giving rise to the claim, unless a separate written agreement states otherwise.

Indemnification
You agree to defend, indemnify, and hold harmless CECTE and its owners, officers, employees, contractors, instructors, consultants, affiliates, and representatives from any claims, damages, losses, liabilities, costs, or expenses arising out of:
Your use of the website, courses, materials, or services
Your violation of these Terms
Your misuse of CECTE materials
Your reliance on training without verifying applicable requirements
Your operational, regulatory, staffing, resident care, documentation, or business decisions
Your violation of any law, regulation, or third-party right

Termination
CECTE may suspend or terminate your access to the website, course platform, account, materials, or services if CECTE believes you violated these Terms, misused the platform, failed to pay required fees, engaged in dishonest conduct, or created legal, operational, reputational, or security risk.
Termination does not entitle you to a refund unless required by law or expressly approved by CECTE.

Changes to Terms
CECTE may update these Terms of Service at any time. Updated terms will be posted on the website with a revised effective date.
Your continued use of the website, course platform, or services after updated terms are posted constitutes acceptance of the updated terms.

Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Dispute Resolution and Venue
Before filing any legal claim, you agree to contact CECTE via the contact form and attempt to resolve the issue informally.
If the issue cannot be resolved informally, any legal action shall be brought in the state or federal courts located in Colorado, unless applicable law requires otherwise.

Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement
These Terms, together with any applicable Privacy Policy, course-specific terms, consulting agreements, or written service agreements, represent the entire agreement between you and CECTE regarding use of the website, courses, and services.
